Terms of Service
The working rules for using bluberri, buying credits, requesting creative work, and receiving final deliverables.
Last updated: June 26, 2026
bluberri is a United States Delaware corporation. These Terms are written for the current beta client portal and may be updated before broader paid-client launch.
1.Using bluberri
- 1.1 These Terms apply when you access or use bluberri's client portal, creative production tools, billing features, and related services.
- 1.2 If you use bluberri for a company or other organization, you represent that you have authority to accept these Terms for that organization.
- 1.3 You are responsible for keeping your account credentials secure and for activity that happens through your account.
2.Creative services
- 2.1 bluberri helps clients request, manage, review, and receive advertising creative and related production work.
- 2.2 You are responsible for the briefs, source materials, claims, products, offers, testimonials, and other content you provide to us.
- 2.3 We may refuse, pause, or revise work that we believe is unlawful, misleading, unsafe, infringing, or outside the scope of the agreed service.
3.Credits, billing, and refunds
- 3.1 Credits are a prepaid unit used for bluberri work. Credits are not cash, are not transferable, and cannot be redeemed for money.
- 3.2 One-off credits are added after Stripe confirms payment and do not expire unless we clearly state otherwise at checkout.
- 3.3 Subscription credits refresh each billing cycle. Unused subscription credits expire at the end of that billing cycle.
- 3.4 Subscriptions renew automatically until cancelled. Cancel before the next renewal date to stop future subscription charges.
- 3.5 Credits already used for requested or delivered work are not refundable. Other refunds are provided only where required by law or where bluberri expressly agrees.
- 3.6 Stripe processes payments. bluberri does not store full card numbers. Stripe may handle card, wallet, dispute, refund, and fraud-prevention information under its own terms and policies.
4.Client content and final deliverables
- 4.1 You keep ownership of materials you upload or submit. You grant bluberri permission to host, copy, process, modify, and display those materials as needed to provide the service.
- 4.2 After full payment for the applicable work, you may use final delivered ads for your business, subject to any third-party rights, platform rules, music or stock-asset restrictions, and these Terms.
- 4.3 bluberri retains ownership of its platform, workflows, templates, know-how, software, reusable production methods, and non-client-specific creative systems.
- 4.4 We do not claim exclusive ownership over general ideas, styles, learnings, or production techniques developed while operating the service.
5.Acceptable use
- 5.1 Do not use bluberri for illegal activity, fraud, deceptive claims, spam, harassment, hateful or violent content, child exploitation, or content that infringes someone else's rights.
- 5.2 Do not interfere with the service, bypass security, scrape non-public data, reverse engineer the platform, or attempt unauthorized access.
- 5.3 Do not use bluberri in ways that would violate payment processor, ad platform, sanctions, export-control, or other applicable rules.
- 5.4 We may remove content, suspend access, or decline work if we believe these rules are violated.
6.Risk allocation
- 6.1 The service is provided on a beta, as-available basis. We work to keep it reliable, but we do not guarantee uninterrupted access, error-free output, or specific advertising results.
- 6.2 To the fullest extent permitted by law, bluberri is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or revenue.
- 6.3 To the fullest extent permitted by law, bluberri's total liability for claims relating to the service is limited to the amount you paid to bluberri for the service giving rise to the claim during the 12 months before the claim.
7.Changes, termination, and Delaware law
- 7.1 We may update these Terms as the product changes. If changes are material, we will try to provide reasonable notice through the portal, email, or another practical method.
- 7.2 You may stop using bluberri at any time. We may suspend or terminate access for nonpayment, security risk, legal risk, or violation of these Terms.
- 7.3 These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law principles.
- 7.4 Questions about these Terms can be sent to support@bluberri.ai.
